In regard to the drawbacks to which I alluded in
paragraph 7 of my report I must point out a further one of some
magnitude. Appeals to the Privy Council must be by leave of the
Full Court and it has been found that if the party concerned desires to appeal after a consideration of the judgment against him he has to wait until the next session of the Appeal Court i.e. some 5 months as one member of the Court is absent from the
Colony. A fortnight ago the Full Court consisting of the Puisne
Judge and myself only took upon ourselves with doubtful authority to grant a stay of execution in such a case pending the applica- -tion to the entire Full Court in its sitting in January. I have kept Sir Havilland informed of the course of the proceedings and I shall sugest to the Attorney-General, for Your Excellency's approval, the insertion of a clause in the amending bill delegat- -ing the right of granting leave to appeal to the Privy Council to two Judges only. This will remove an obvious impediment to a liti- -gant's right in getting his case heard as soon as possible by the Privy Council.
